Quick summary
- Whoever creates the account is responsible for it and for the profiles they create.
- In class, the school handles registration; students do not provide contact details.
- The AI Tutor can make mistakes: it helps, but does not replace the teacher.
- You can close your account whenever you want.
The summary helps, but does not replace the full text.

Welcome to Pupilu. These Terms describe the rules for using our app, website, and administrative panels by guardians, students, teachers, and schools. Please read them carefully; using the Service implies full acceptance of these Terms.
1About these Terms
These Terms of Use ("Terms") govern access to and use of the Pupilu mobile app, website, and administrative panels (together, the "Service"), provided by 3A TECH ("Pupilu", "we"), registered under CNPJ No. 55.668.091/0001-20, headquartered in São Paulo, Brazil.
By creating an account, activating a profile, joining with a class code, or using any part of the Service, you confirm that you have read, understood, and accepted these Terms and the Privacy Policy. If you are a school or teacher, acceptance binds the institution you represent.
If you do not agree with any part of these Terms, do not use the Service.
2Definitions
- Account: a record kept by an adult Guardian, with their own email and password.
- Student Profile: an educational record linked to an Account (Full Mode) or to a Partner School (Class Mode).
- Guardian: a person aged 18 or over with parental authority or legal representation over the student.
- Partner School: an educational institution that contracts Pupilu under a commercial license.
- Teacher: a professional linked to a Partner School, with access to the school panel.
- Class Mode: access arranged by the school; the student joins with a class code and their name, without registering an email.
- Full Mode: complete access, with an adult Guardian Account acting as controller of the minor's data.
- Adoption: the act by which a Guardian links a Student Profile previously created in Class Mode to their Account.
- Plan: the subscription level contracted (Free, Plus, School).
- Pupilu Content: paths, lessons, exercises, texts, images, audio, code, design, and trademarks displayed in the Service.
3Who may use the Service
- Adults (18 or older) may create an Account and use the Service on their own.
- Adolescents (13 to 17) may only use the Service under a Guardian's Account (Full Mode) or through a Partner School (Class Mode).
- Children (under 13) may only use the Service through a Guardian who has given express consent (Full Mode) or through a Partner School that has contracted the Service (Class Mode).
- The Guardian is responsible for all actions taken by minors under their Account, including accepting terms, choosing a plan, and messages sent to the AI Tutor.
4Individual registration (Guardian)
The Guardian creates an Account by providing a name, a valid email, and a password. The email will be used for authentication, operational communications (billing, alerts, and security), and for exercising rights provided by law.
The Guardian may create Student Profiles up to the limit of the contracted Plan (up to three on Plus). Each Profile corresponds to a child or adolescent under their responsibility.
Creating Student Profiles on behalf of people who are not under your legal responsibility is prohibited.
Sharing credentials is prohibited. In case of misuse, let us know immediately at contato@pupilu.com.br.
5Access through a Partner School (Class Mode and Adoption)
The Partner School contracts the Service through a School License, in which it defines how many seats (Student Profiles) it wishes to use and which teachers will have access to the panel.
The teacher creates the Student Profiles in advance; in class, the student joins with a class code and types their name to start Class Mode. No email, phone number, address, or other contact data of the minor is collected at this point.
XP, progress, and ranking earned in Class Mode remain restricted to the school environment and are not added to the global ranking until Adoption occurs.
When a Guardian adopts a Class Mode Profile using an adoption code, the Profile moves to Full Mode: XP is consolidated, the Guardian's express consent takes effect, and Pupilu begins to process the data under the Privacy Policy applicable to home users.
Class Mode Profiles that remain unadopted for long periods may be deactivated (freeing the school's seat) and later have their data purged as described in the Privacy Policy.
6School and Teacher Accounts
The Partner School designates authorized staff (teachers, coordinators) who receive individual credentials to access the school panel. Credentials are personal, non-transferable, and must be protected by their holder.
Teachers only see data of students linked to their school and, where applicable, to their classes. Attempting to access data of other schools or classes is prohibited.
The School is responsible for keeping the list of authorized teachers up to date and for revoking access when the professional relationship ends.
The School is the controller of the data of students in Class Mode, as described in the Privacy Policy. Pupilu acts as processor in this scenario.
7Expected conduct
- Do not share credentials or allow third parties to use your Account.
- Do not attempt to access data of other users, schools, teachers, or students.
- Do not use scripts, bots, automation, or multiple accounts to inflate XP, streaks, ranking, or achievements.
- Do not send the AI Tutor offensive, sexual, violent, or discriminatory content, hate speech, self-harm, drugs, party politics, religious proselytism, or requests for personal information about third parties.
- Do not attempt to bypass safety filters, message limits, or restrictions of the contracted Plan.
- Do not copy, redistribute, translate, sublicense, or reverse engineer Pupilu Content.
- Respect teachers, classmates, and the support team. Abusive behavior may result in immediate suspension.
8Intellectual property
All Pupilu Content — paths, lessons, exercises, illustrations, animations, source code, brand, visual identity, and gamification mechanics — is the exclusive property of Pupilu or its licensors and is protected by Brazilian copyright, trademark, and industrial property laws.
We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the Service for as long as the contractual relationship lasts and strictly for the intended educational purposes.
Copying, modifying, distributing, selling, renting, sublicensing, publicly displaying, or creating derivative works from Pupilu Content without prior written authorization is prohibited.
9User-submitted content
Messages sent to the AI Tutor, exercise answers, comments, and other content submitted to the Service remain authored by the user.
You grant Pupilu a non-exclusive, royalty-free, worldwide license to store, process, display, and use such content to operate the Service, ensure platform security, improve educational models, and comply with legal obligations.
Content may be reviewed automatically and, in exceptional cases, by human staff for moderation, support, or legal compliance. Human access is restricted, logged, and follows internal data protection procedures.
10Paid plans, subscriptions, and billing
Pupilu offers free plans and paid plans (Plus and School). The terms, prices, billing cycles, and benefits of each plan are described in the app, on the website, or in the Partner School's commercial contract, as applicable.
Individual subscriptions are billed through app stores (App Store, Google Play) or through a web payment gateway. Renewal is automatic until canceled by the holder.
Cancellation of subscriptions purchased in a store follows that store's policies and deadlines. Subscriptions purchased on the website can be canceled directly in the Account area.
Refunds follow the policy of each billing channel and applicable consumer protection law.
Annual price adjustments will be announced at least 30 days in advance by email and/or in-app notice.
For Partner Schools, commercial terms (seats, term, adjustments, invoicing) follow the signed contract, which prevails over these Terms regarding price and term.
11Lives, XP, streaks, and ranking
Gamification mechanics (lives, XP, streaks, achievements, ranking) are educational and engagement features and do not entitle anyone to any prize in money, goods, or services.
Pupilu may, at any time and without prior notice, adjust formulas, limits, regeneration rules, ranking scopes, and progress mechanics to improve the educational experience or prevent abuse.
If abusive use is detected (bots, multiple accounts, exploiting bugs), Pupilu may reset scores, suspend access, and remove improperly obtained Achievements.
12AI Tutor
The AI Tutor is a feature that uses language models provided by third parties ("AI Provider") to answer educational questions within the scope of Pupilu.
Answers are generated automatically and may contain inaccuracies, omissions, or errors. They do not replace guidance from teachers, guardians, or qualified professionals.
For children and adolescents, the AI Tutor runs with additional filters that block sensitive topics (violence, sex, drugs, party politics, religion, self-harm, personal data, in-person contact).
Conversations are stored for security, improvement, and legal compliance purposes, as described in the Privacy Policy. Where applicable, corporate contracts with the AI Provider prohibit using these messages to train models.
Pupilu may limit the number of daily messages per Plan and turn off the feature for students whose Partner School has disabled AI.
13Suspension and termination
You may close your Account at any time from the Profile screen or by contacting support. Closing the Account disables access and starts the retention/purge periods described in the Privacy Policy.
Pupilu may suspend or terminate Accounts, Profiles, or School/Teacher access in case of breach of these Terms, fraud, court order, risk to platform security, or non-payment.
In serious cases, suspension may be immediate and without prior notice. Curable issues will be communicated with a reasonable period to resolve them.
14Availability, maintenance, and disclaimer of warranties
Pupilu makes reasonable efforts to keep the Service available but does not guarantee uninterrupted, error-free operation or immunity from third-party failures (cloud providers, app stores, carriers, AI).
Scheduled maintenance may cause temporary unavailability. Whenever possible, it will be announced in advance.
The Service is provided "as is", without implied warranties beyond those required by law.
15Limitation of liability
To the maximum extent permitted by applicable law, Pupilu's total liability for any claims related to the Service is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim.
Pupilu is not liable for indirect damages, lost profits, data loss not attributable to its own failure, or losses resulting from use of the Service in breach of these Terms.
Nothing in these Terms limits liability that cannot be limited by law (such as basic consumer rights).
16Changes to these Terms
Pupilu may update these Terms to reflect changes in the Service, the law, or operational practices. Material changes will be announced at least 15 days in advance by email and/or in-app notice.
Continued use of the Service after the new version takes effect constitutes acceptance. If you do not agree, you must stop using the Service and may request that your Account be closed.
17Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the District of São Paulo, Brazil, are elected to settle disputes, except where consumer jurisdiction rules favor the consumer.
